Amenzi de p\u00e2n\u0103 la 100.000 de lei pentru televiziuni \u0219i posturi radio ce vor r\u0103sp\u00e2ndi dezinformare\u00a0"},"content":{"rendered":"<p><\/p>\n<p style=\"text-align: justify;\"><strong>Restric\u021bii pentru achizi\u021bionarea con\u021binuturilor audiovizuale care nu au ratificat Conven\u021bia european\u0103 privind televiziunea transfrontalier\u0103, introducerea no\u021biunii de dezinformare \u00een lege \u0219i sanc\u021biuni de p\u00e2n\u0103 la 100.000 de lei pentru furnizorii de servicii media care vor difuza dezinformare ce afecteaz\u0103 securitatea na\u021bional\u0103 \u0219i securitatea informa\u021bional\u0103 a \u021b\u0103rii, aceste \u0219i alte propuneri se reg\u0103sesc \u00een noul <\/strong><a href=\"https:\/\/www.parlament.md\/ProcesulLegislativ\/Proiectedeactelegislative\/tabid\/61\/LegislativId\/5941\/language\/ro-RO\/Default.aspx\"><strong>proiect de lege<\/strong><\/a><strong> privind contracararea \u0219tirilor false. <\/strong><a href=\"https:\/\/www.parlament.md\/ProcesulLegislativ\/Proiectedeactelegislative\/tabid\/61\/LegislativId\/5941\/language\/ro-RO\/Default.aspx\"><strong>Documentul<\/strong><\/a><strong> a fost \u00eenregistrat pe 5 aprilie \u00een Parlament \u0219i urmeaz\u0103 a fi dezb\u0103tut de plen \u00een prima lectur\u0103.<\/strong><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Proiectul de lege va reglementa no\u021biunea de dezinformare \u0219i \u00een Codul serviciilor media audiovizuale (CSMA), defini\u021bia fiind preluat\u0103 din Codul Uniunii Europene de bune practici privind dezinformarea. Termenul este definit \u00een proiect drept \u201er\u0103sp\u00e2ndire de informa\u021bii false sau \u00een\u0219el\u0103toare (reflectate distorsionat, cu con\u021binut fabricat, exagerat, scoase din context sau plasate \u00eentr-un alt context, opinii (interesate) preluate \u0219i transformate \u00een informa\u021bii valide cu argumentare tenden\u021bioas\u0103 etc.), care sunt create, prezentate \u0219i diseminate pentru a ob\u021bine un c\u00e2\u0219tig economic, a induce publicul \u00een eroare \u00een mod deliberat sau pentru a provoca un prejudiciu public, precum \u0219i propaganda ostil\u0103 valorilor democratice \u0219i informa\u021biile false care presupun amenin\u021b\u0103ri aduse proceselor democratice, politice sau de elaborare a politicilor, ori amenin\u021b\u0103ri aduse bunurilor publice precum securitatea informa\u021bional\u0103 a Republicii Moldova, s\u0103n\u0103tatea cet\u0103\u021benilor, mediul etc\u201d.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><strong>OPERE AUDIOVIZUALE EUROPENE<\/strong><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Autorii ini\u021biativei propun ca, \u00een cazul serviciilor de televiziune, programele audiovizuale achizi\u021bionate de peste hotare s\u0103 provin\u0103 sau s\u0103 fie produse \u00een propor\u021bie de cel pu\u021bin 50% \u00een statele membre ale Uniunii Europene, SUA \u0219i Canada precum \u0219i alte state care au ratificat Conven\u021bia european\u0103 privind televiziunea transfrontalier\u0103. Mai mult, se interzice achizi\u021bionarea programelor produse de filiale sau reprezentan\u021be ale furnizorilor care provin din state ce nu au ratificat Conven\u021bia, indiferent de locul activit\u0103\u021bii acestora. Rusia \u0219i Belarus nu se reg\u0103sesc \u00een lista \u021b\u0103rilor care au ratificat actul.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">De asemenea, proiectul de lege propune revenirea la normele privind programele audiovizuale achizi\u021bionate, operele audiovizuale europene \u0219i cele ce \u021bin de protejarea spa\u021biului audiovizual na\u021bional. Bun\u0103oar\u0103, \u00een cazul serviciilor media audiovizuale liniare, furnizorii de servicii media ar putea fi obliga\u021bi s\u0103 dedice operelor audiovizuale europene cel pu\u021bin 50% din timpul de emisie al fiec\u0103rui serviciu, din care se scade timpul alocat \u0219tirilor, evenimentelor sportive, jocurilor, publicit\u0103\u021bii, serviciilor de teletext \u0219i teleshopping, iar \u00een cazul serviciilor media audiovizuale neliniare, furnizorii ar putea fi obliga\u021bi s\u0103 rezerve operelor audiovizuale europene cel pu\u021bin 30% din catalogul de programe.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Totodat\u0103, \u00een cazul serviciilor media audiovizuale liniare, televiziunile ar putea fi obligate s\u0103 rezerve operelor audiovizuale europene create de c\u0103tre produc\u0103torii independen\u021bi din Republica Moldova cel pu\u021bin 10% din timpul de emisie al fiec\u0103rui serviciu. Aceste propuneri nu se aplic\u0103 posturilor de radio, serviciilor de televiziune locale \u0219i comunitare, precum \u0219i serviciilor media audiovizuale dedicate exclusiv publicit\u0103\u021bii \u0219i teleshoppingului.<\/span><\/p>\n<p style=\"text-align: justify;\"><strong>PROTEJAREA SPA\u021aIULUI AUDIOVIZUAL NA\u021aIONAL<\/strong><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">\u00cen scopul protej\u0103rii spa\u021biului audiovizual na\u021bional \u015fi asigur\u0103rii securit\u0103\u021bii informa\u021bionale, autorii au propus noi prevederi. Una din ele men\u021bioneaz\u0103 c\u0103 furnizorii de servicii media audiovizuale nu vor putea difuza, iar distribuitorii de servicii media audiovizuale nu vor putea retransmite programe audiovizuale care au fost ini\u021bial produse \u00een state care nu au ratificat Conven\u021bia European\u0103 privind televiziunea transfrontalier\u0103, cu excep\u021bia filmelor artistice \u0219i de scurt metraj care nu au con\u021binut militar, precum \u0219i a emisiunilor de divertisment ce nu au con\u021binut militar \u0219i a programelor audiovizuale care sunt produse \u00een statele membre ale Uniunii Europene, \u00een Statele Unite ale Americii \u0219i Canada, precum \u0219i \u00een statele care au ratificat Conven\u021bia men\u021bionat\u0103.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">De asemenea, se propune ca furnizorii de servicii media s\u0103 nu poat\u0103 difuza \u0219i distribuitorii de servicii media s\u0103 nu retransmit\u0103 programe audiovizuale care, indiferent de provenien\u021ba lor, sunt calificate drept cele care con\u021bin informa\u021bii ce afecteaz\u0103 securitatea spa\u021biului audiovizual na\u021bional sau dezinformare.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><strong>COMUNIC\u0102RI COMERCIALE \u0218I SANC\u021aIUNI<\/strong><span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Mai mult, autorii propun ca furnizorii priva\u021bi de servicii media care au printre fondatori \u0219i\/sau proprietari beneficiari autorit\u0103\u021bi\/institu\u021bii publice ale altor state s\u0103 fie lipsite de dreptul de a difuza comunic\u0103ri comerciale audiovizuale, cu excep\u021bia celor de autopromovare. De asemenea, serviciile de televiziune care nu se afl\u0103 \u00een jurisdic\u021bia Republicii Moldova nu vor con\u021bine publicitate, \u00een caz c\u0103 propunerile vor trece.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">O serie de propuneri prev\u0103d aplicarea sanc\u021biunilor f\u0103r\u0103 respectarea mecanismului standard &#8211; de la avertizare public\u0103, amend\u0103, suspendarea licen\u021bei de emisie, p\u00e2n\u0103 la retragerea acesteia. Astfel, pentru \u00eenc\u0103lcarea prevederilor privind programele audiovizuale locale, se exclude sanc\u021biunea cu avertizare public\u0103 \u0219i se introduce un nou tip de sanc\u021biune, \u0219i anume suspendarea dreptului de a difuza comunic\u0103rile comerciale audiovizuale de la \u0219ase luni p\u00e2n\u0103 la un an \u0219i suspendarea licen\u021bei de emisie a furnizorului de servicii media care a \u00eenc\u0103lcat decizia CA privind suspendarea dreptului de a difuza comunic\u0103rile comerciale. Pentru \u00eenc\u0103lcarea prevederilor privind retransmisiunea publicit\u0103\u021bii \u0219i teleshoppingului se introduc amenzi de la 25.000 de lei la 30.000 de lei, \u0219i alte 40.000 de lei la 70.000 de lei pentru \u00eenc\u0103lcarea repetat\u0103 a prevederilor, urmate de suspendarea autoriza\u021biei de retransmisie pentru o perioad\u0103 de la \u0219ase luni p\u00e2n\u0103 la un an.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">\u00cen cazul dezinform\u0103rii ce afecteaz\u0103 securitatea na\u021bional\u0103 \u0219i cea informa\u021bional\u0103 a \u021b\u0103rii se impun acelea\u0219i trepte de sanc\u021bionare pentru \u00eenc\u0103lc\u0103ri repetate ca \u0219i \u00een cazul discursului care incit\u0103 la ur\u0103 &#8211; amenzi de la 40.000 de lei la 70.000 \u0219i de la 70.000 la 100.000 de lei.
